Avoid perception-driven verdicts, have self-assessment: PM tells judiciary

New Delhi: Advising judiciary to avoid "perception-driven" verdicts, Prime Minister Narendra Modi today said it should have an internal mechanism of "self-assessment" as judges are considered "divine" and seldom face any criticism unlike the political class.
Addressing a conference of top judges from across the country in New Delhi, he said while the judiciary is getting powerful, it is necessary that it also becomes "perfect" to live up to the expectations of the people.



"It is easy to deliver judgements based on the law and the Constitution. There is a need to be cautious against perception-driven verdicts," he said, adding that "perceptions are often driven by five star activists". Noting that the judiciary is considered "divine" and next only to the God, he advised it to have an internal mechanism for self-assessment, which he said, is a "difficult" task.
"We (the political class) are lucky that people watch us, assess us and rip us apart. You (Judiciary) are not as lucky. "If you order a person to death, he also comes out and says that he believes in the judiciary...When there is little scope for criticism, the need of the hour is to develop an internal mechanism for self-assessment where the government and the politicians have no role," the prime minister said addressing the joint conference of Chief Justices of the 24 high courts and chief ministers.
He said if such a mechanism is not evolved and the faith in the judiciary is affected even a little bit, it will hurt the nation.
"If the politicians or the government make a mistake, there is a scope to repair the damage by the judiciary. But if you commit a mistake, then everthing will end," he said.
Modi's remarks came close on the heels of an impeachment motion being moved in Parliament against a judge of the Madhya Pradesh High Court for alleged sexual harassment of a woman judicial officer.
Talking about the scrutiny that the government and political class faces, the prime minister said the Executive has set up institutions like Election Commission, RTI and Lokpal despite knowing that these would place a check on the Executive.
"Politicians are under increased scrutiny today. Earlier, items, which did not find a place even in gossip columns of newspapers, become breaking news today," he said.
The prime minister also favoured a comprehensive review of the system of government-appointed Tribunals to assess their efficacy and effectiveness.
Committed to scrap obsolete Acts, Modi said laws are sometimes not drafted well and therefore lead to multiple interpretations.
"There should be minimum grey areas, and therefore, drafting of laws requires special attention," he
said, adding that though no law an can have "zero defect", the grey areas in legislations can be reduced.
Noting that nearly 1,700 redundant laws have been identified for repeal, he said he hopes to repeal one
redundant law per day in his tenure.
He said good infrastructure for the Judiciary was a priority for the government, and an amount of Rs 9,749 crore had been earmarked for strengthening the Judiciary under the 14th Finance Commission.

He hoped that states would not divert the funds meant for improving judicial infrastructure given under the 14th Finance Commission.
Under the Digital India Programme, technology should be deployed to bring about a qualitative change in the judiciary, the prime minister said.
He stressed that quality manpower was required for the judiciary as he voiced concern about the human resource as also physical infrastructure. Modi stressed the need for more educational institutions dealing with law and legal services.
Without going into the details of pendency in litigation and corruption in the judiciary, Modi hoped the conclave of judges would suggest some fresh approaches to deal with these issues.
He said Lok Adalats were an effective way of dispensing justice for the common man, and this mechanism should be strengthened further.
Laying stress on the importance of family courts, Modi said such institutions were necessary as families were fast breaking up and there was a need to check the trend.
He stressed the need for preparing for emerging areas of litigation such as maritime law and cyber crime. He said acquaintance with forensic science is now a must for those associated with the legal profession.

Speaking on this occasion, Jayasudha said all actors will remain united and work sincerely even though both panels criticized each other. Nandamuri Balakrishna, after casting his vote, stated that the comprehensive development of cine industry was his aim and opined that the elections this time were interesting.
Contestant Rajendra Prasad said his supporters welcomed the members politely and asked them to cast their votes for change and for the good.
Out of a total number of 702 voters, only 394 of them cast votes through EVMs. Actors Nandamuri Balakrishna, Murali Mohan, Nagababu, Prakash Raj, Manchu Vishnu, Laxmi Prasanna, Krishnam Raju, Brahmanandam, Rao Ramesh, Ajay, Giribabu, Ravi Babu and others exercised their franchise.
Meanwhile, Returning officer Krishna Mohan has stated the EVMs will be opened only after the Court orders. He said the election process was shot in video following directions of the Court and the same will be shown to the Court on March 31.

Washington, D.C. :  Prime Minister Benjamin Netanyahu won the fourth term  in the Israeli parliamentary elections held on Tuesday. The election was not between Netanyahu and the rest, as the race came too close in the end of the campaigns between Likud and the Labor parties. Likud party has eventually emerged as the largest single party.
Benjamin Netanyahu, the Likud party leader, and Isaac Herzog, the Labor party leader, campaigned hard in the elections, and since Netanyahu won he will be the leader who holds the office of Israel Prime Minister for a longer period. He was elected three times before.
Political pundits said it was going to be a very close call but the results were clear who the winner was. Netanyahu has been steadily preparing for the elections, yet, in the end of the campaign, he is more concerned that he could lose. He thinks that the Arabs turnout may take the votes away from him. In the months before the elections he had been vocal against the nuclear deal between the US and Iran. He made the Iran issue central to his campaign. He even addressed the US congress, which is a rare opportunity for any world leader, and said the Iran deal is a bad deal and the Congress should not support the deal. To that extent, the Republican Congress sent a letter to the Iranian Government stating that the Congress would not support a deal and would repeal once the deal reaches them.
All this initially seemed to play out well for Netanyahu in Israel, but did not really seem to make any difference in the elections. Recently in the campaign, he made it clear that he will never allow statehood for Palestinians, reversing his stance he took six years ago. This statement naturally made the Arabs angry and disaffected not only in the country but all around the world. However, the elections are also about the economic conditions of the country. With the prices rising, people need a strong leader who can deliver the promises.
Now it remains to be see whether the fourth term of Netanyahu as prime minister would help in bringing peace and prosperity to Israel.

TS cops have shown guts, says KCRHYDERABD: Chief Minister K Chandrasekhar Rao today warned of serious action against the anti-social elements and those who cause impediment to law and order. The Government will suppress with iron hand the assailants and goons involved in such incidents, he warned. KCR appreciated police personnel for showing guts and valour in tackling the anti-social elements and assailants involved in Suryapet firing incident.
In a communiqué released here, the Chief Minister, while giving pat to the police for their sacrifice, said their bravado will remain in the history of Telangana State. He enquired about the well-being of the policemen at the hospital and asked the officials to provide the best treatment. “The policemen fought with anti-social elements at the cost of their own lives”, the Chief Minister noted. He said Circle Inspectors Mogilaiah, Balagangi Reddy, Athmakur SI Siddaiah, Home Guard Kishore bravely fought with the assailants. He said policemen sacrificed themselves while discharging their duties including Lingaiah, Home Guard Mahesh and another constable killed in encounter.
The Chief Minister said his government will not tolerate such incidents and suppress the criminals with iron hand. Expressing shock at the incident in which a few policemen were killed, the CM said that the Government will bear the expenditure towards the medical services being made to the ailing policemen at Kamineni Hospital. He directed the officials to provide the best treatment to the policemen. KCR also said the government will provide them complete help financially and otherwise. The policemen played a great role in nabbing the assailants, he said, adding that the government will provide all help to the deceased families.
